1.3 Cookies and Tracking

We do not directly collect cookies for our own tracking or analytics, so we do not display a cookie banner. However, users can opt in to allow third-party embeds (e.g., YouTube videos) in their post feed. These third-party services may set cookies or collect usage data on their own. We do not control how third parties use their cookies or tracking technologies, and any data they collect is governed by their own privacy policies. If you have questions about these third-party practices, please review their policies directly.

If you need a more detailed explanation of how cookies and similar technologies might be used by third parties, you may consult a dedicated cookie or tracking policy on those external sites, or visit your browser settings to learn more about controlling cookies.

1.4 Third-Party Services and Tools

  • Hosting: DigitalOcean hosts our application and databases.
  • Debugging: Sentry helps us monitor and fix application errors.
  • Analytics: PostHog on EU GDPR-compliant servers without tracking cookies for usage metrics.

2. HOW DO WE PROCESS YOUR INFORMATION?

We process your personal information for purposes such as:

  • User-to-User Interactions: Enabling social or communication features if you choose to use them.
  • Legal Compliance & Protection: Complying with laws, enforcing our Terms of Use, or protecting vital interests.

3. LEGAL BASES FOR PROCESSING

We only process personal information when we have a valid legal basis, such as:

  • Consent: Where you grant permission (e.g., to collect sensitive data or contact you for marketing).
  • Contractual Necessity: Fulfilling a contract with you (e.g., user account, billing).
  • Legal Obligations: Compliance with laws or regulations.
  • Legitimate Interests: When processing is necessary for our business interests (e.g., security) and not overridden by your rights.

If you are in a region (e.g., EEA, UK) requiring specific legal justifications, we comply with local data protection laws accordingly.

4. WHEN AND WITH WHOM DO WE SHARE YOUR INFORMATION?

4.1 Service Providers and Partners

We may share your information with trusted third parties who perform services on our behalf:

  • Payment processing (e.g., Gumroad)
  • Hosting and storage (e.g., DigitalOcean)
  • Debugging and analytics (e.g., Sentry, PostHog)

These providers are obligated to protect your data and can only process it based on our instructions.

4.2 Business Transfers

In the event of a merger, acquisition, or sale of assets, we may transfer your information to the new entity.

4.3 Other Users

If you share content in public areas of our Services (e.g., community posts), that information can be seen by other users and the public. This includes any sensitive data you choose to display in your profile.

4.4 Legal Obligations

We may disclose your information when required by law or if necessary to protect our rights, safety, property, or that of others.

5. INTERNATIONAL DATA TRANSFERS

If we process data from EU residents, we use Standard Contractual Clauses (SCCs) or other legally approved mechanisms to ensure appropriate safeguards for cross-border data transfers. By using our Services, you consent to having your personal data transferred to and processed in jurisdictions outside your own, as permitted by applicable law.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

We retain personal data as long as necessary to fulfill the purposes outlined in this Notice, unless a longer retention period is required by law. No purpose in this Notice requires us to keep your personal information longer than 3 months after the termination of your account, unless legally mandated. Please note:

  • Operational Data: Deleted or anonymized when no longer needed.
  • Backups: Some data may remain in backups for up to one year. These backups are maintained for disaster recovery and security continuity, and access to personal data within backups is restricted. When restoring from a backup, we will apply our standard data deletion protocols to any restored data that should otherwise have been removed.

This approach is typically allowable under GDPR if access to historical backups is strictly limited and data subject rights are honored when data is restored. However, if you have specific concerns, please contact us.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

We implement reasonable technical and organizational security measures (e.g., secure hosting, restricted access). However, no online service is completely secure. Use our Services at your own risk and only over secure connections.

8. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly collect or market to children under 18. If you are under 18, please do not provide personal information to us. If we learn we have collected data from a user under 18, we will delete it. To report such data, email [email protected].

9. WHAT ARE YOUR PRIVACY RIGHTS?

Depending on your location, you may have rights including:

  • Requesting a copy of your personal information or data portability.
  • Requesting corrections of inaccurate or incomplete data.
  • Requesting deletion or anonymization (subject to legal exceptions).
  • Objecting to or restricting certain processing.
  • Withdrawing consent where processing is based on consent.

To exercise these rights, email [email protected] or visit https://acespace.love. We respond according to applicable laws.

Reasonable Fee: We reserve the right to charge a fee equivalent to the market rate for an experienced software/data engineer contractor to handle your request, in addition to any costs incurred by us if your request requires excessive time or labor. This fee can be quite high, and is intended to serve as a disincentive to particularly large or burdensome requests. We prefer not to charge such fees and strive to handle normal requests free of charge.

10. OPTING OUT OF MARKETING

To unsubscribe from marketing emails, click the “unsubscribe” link or contact us. We may still send service-related communications (e.g., account or policy updates).

11. THIRD-PARTY WEBSITES

Our Services may link to sites or apps not operated by us. We are not responsible for their content or privacy/security practices. Please review their privacy policies directly.

12. SOCIAL LOGINS

If you register or log in via a social media account, we may receive profile information from that provider (e.g., name, email). We use this data only for the purposes described in this Notice or as stated within our Services.

13. DO-NOT-TRACK FEATURES

Most browsers and some mobile systems include a Do-Not-Track (DNT) feature. No universal standard exists for recognizing DNT signals, so we do not respond to them at this time. If that changes, we will update this Notice.

14. CALIFORNIA RESIDENTS’ PRIVACY RIGHTS

California residents may have specific rights under the California Consumer Privacy Act (CCPA) or “Shine The Light” law, such as requesting disclosure of how their data is shared or requesting its deletion. If you are under 18, reside in California, and have a registered account, you can request removal of publicly posted content. To learn more or exercise your rights, contact [email protected].

15. VIRGINIA RESIDENTS’ PRIVACY RIGHTS

If you are a “consumer” under the Virginia Consumer Data Protection Act (CDPA), you may have rights including accessing, correcting, or deleting your personal data, or opting out of certain processing. We do not sell personal data. For more information or to exercise your rights, please contact us.

16. DO WE MAKE UPDATES TO THIS NOTICE?

We may update this Privacy Notice from time to time to comply with changing laws or reflect changes in our practices. The “Revised” date at the bottom indicates the latest update, which is effective as soon as posted. If we make material changes, we may notify you with a prominent notice on our site or via email.

17. HOW TO CONTACT US

If you have questions, comments, or requests regarding this Privacy Notice, please contact us:

  • Mail: AceSpace Limited, Suite A, 82 James Carter Road, Ipswich, IP28 7DE, England

18. REVIEW, UPDATE, OR DELETE YOUR DATA

You may request to review, update, or delete personal data we collect, subject to certain exceptions. You can delete your account and related data for free at any time by using the "Delete Account" button located in your Account Settings. Do note that this is not reversible and your account will not be recoverable. We support "Account Deactivation" that allows an account to become active again upon subsequent login.

You can also request to delete your account via email at [email protected]. We discourage the use of contacting us via email to delete an account and reserve the right to charge a reasonable administration fee to cover staffing costs used to perform this action. Remember our Reasonable Fee clause mentioned above if your request is notably large or complex.
